Driver spins out on Texas highway and smashes into wall

My wife and I and our two boys ages 5 and 7 were on our way to Grandma's house for a nice visit and dinner. The vehicle was trying to get in the fast lane when he spins out and hits the center divider. A piece of his vehicle flies off and hits our windshield which causes two chips and scratches up the entire width of the glass. Turns out his license is expired and wasn't listed as a driver on the insurance. I tried to work with the person to avoid an insurance claim for him as it wasn't very expensive to get repaired but he would never commit to meeting, claiming work was slow etc. That's how I came to find out he wasn't covered as my claim with the vehicles insurance company was denied. I sent a text stating as much and asking him if he was going to make the situation right but didn't hear from him for months. I recently received a phone call from his wife stating that he was in jail and when she picked up his belongings she saw the texts messages between her husband and me. She apologized profusely saying that this was the first she had heard of me or my damage claim and that she would pay for the damages. I told her that was great and there was no hurry since the damage was minimal and just to keep me notified.
