A customer at a Dollar Tree store in Daly City, California refused to wear a face mask while claiming he "can't breathe."

The incident happened on July 18 after an employee instructed the man to wear a face mask to keep in line with the store's policy.

The man, who identified himself as Andre Duran, began ranting at the filmer stating he didn't have to share his medical information and that he recently tested negative for COVID-19.

As the altercation continues his children in the background are seen becoming visibly upset.

According to the filmer, the man "misgenders the [trans] employee on purpose" by repeatedly addressing her as "sir."

The filmer told Newsflare: "A man harasses an employee in a store because he refuses to wear a mask. He goes on religious tirades and misgenders the employee on purpose while ignoring his family, causing them embarrassment, and causing his son to cry."

The police were called but the customer ended up leaving before they arrived.
