男子街头被自家牛踢飞撞上货车后致残 法院：双方均存在过错
2020年11月，浙江宁海，农民老黄牵着牛走在非机动车道上，一货车鸣笛驶过时牛受到惊吓，将老黄踢向小赵驾驶的牵引车后轮。事故造成老黄一处八级伤残、一处九级伤残、一处十级伤残。
交警大队经调查，无法判断事故成因。因无法划分事故责任，老黄与小赵及保险公司多次协商赔偿事宜未果。今年9月，老黄向法院提起诉讼，要求小赵和保险公司赔偿各项损失共计60万元。
接到案件后，承办法官第一时间组织双方进行了调解，围绕双方的争议焦点，剖析案情，积极沟通。由于老黄在行走时紧靠机动车道，没有按照交通规则靠路边行走；而小赵这边，在驾车临近牛时突然鸣笛，可能造成牛受到惊吓，因此双方均存在过错。最终，原被告双方握手言和，签订了调解协议，由保险公司赔偿老黄事故损失33万余元。（视频由浙江台提供）
