The Federal Court of San Martín, through its Chamber I, issued a key ruling in the case that pits the Argentine Football Association (AFA) against the government of Javier Milei for the implementation of Sports Anonymous Companies (SAD). This ruling represents an important victory for the head of the AFA, Claudio "Chiqui" Tapia, and nullifies the article that authorized the entry of private capital into the clubs.
In the resolution, the judges decided to maintain the precautionary suspension of the effects of the Decree of Necessity and Urgency (DNU) 70/2023 and its regulations (Decree 730/2024). This decree attempted to authorize the entry of private capital into sports clubs, altering their traditional legal structure as non-profit civil associations.
