The unsigned majority opinion stated that listing sex at birth “no more offends equal protection principles than displaying country of birth,” calling it a “historical fact.” Justices cited “foreign affairs implications” as a reason to defer to the administration’s authority over passport standards. In dissent, Justice Ketanji Brown Jackson argued the ruling would cause “immediate infliction of injury” to transgender travelers, while offering “no adequate justification.” The case stems from a Trump executive order signed in January directing the State Department to ensure passports “accurately reflect the holder’s sex.” Civil rights advocates, including the ACLU, sued to block the rule, calling it discriminatory and unconstitutional under equal protection laws. The ruling temporarily lifts an injunction by a Boston federal judge who had blocked enforcement, pending a final ruling on the legality of the policy.
