Kenya: Kenyan Women Celebrate High Court Victory For Seed Rights

The footage shows smallholder farmers and activists celebrating in a grassy field bordered by acacia trees as they respond to Justice Rhoda Rutto’s decision striking down key sections of the 2012 Seeds and Plant Varieties Act. The ruling declared unconstitutional the provisions that had criminalized saving, sharing, selling, or exchanging unregistered indigenous seeds. Those rules had exposed farmers to penalties of up to two years in prison and fines of 1 million Kenyan shillings ($7,700 USD), while also giving officials authority to raid community seed banks. The decision protects farmer-managed seed systems relied on by more than 80% of Kenya’s smallholders. It is hailed as a major step for food sovereignty, climate resilience, and peasant rights under Article 19 of the UN Declaration on the Rights of Peasants (UNDROP). In the video, the women display a large white banner reading “MY SEEDS MY FUTURE” as they celebrate the verdict. Their chants, movement, and collective relief reflect immediate grassroots support for the court’s stand against corporate control of the seed market and in favor of traditional seed practices.
