Colombia: Former Colombian President Alvaro Uribe sentenced to 12 years of house arrest

Having concluded the procedural stage of the oral trial, the conviction sentence announced in this process is issued, conducted against Alvaro Uribe Velez as the mastermind of the crimes of procedural fraud in homogeneous and heterogeneous concurrence with bribery in criminal proceedings, and acquittal regarding bribery, without evidence of transgression of the constitutional and legal prerogatives held by the parties and special interveners, whose operative part reads as follows: In merit of the foregoing, the 44th Criminal Circuit Court with jurisdiction, Bogotá, administering justice in the name of the Republic and by authority of the law, resolves: First: To acquit Álvaro Uribe Velez, identified with citizenship card 70.041.053 from Medellín, of the conduct of bribery in relation to the event called Ilda Nino Farfan. Likewise, he is acquitted of the crime of procedural fraud in the event called Pacho Cundinamarca in relation to Harlington Mosquera, in accordance with the motivations previously stated. Second: To convict Álvaro Uribe Velez, identified with citizenship card 70.041.053 from Medellín, to the main penalty of 144 months in prison, or what is the same, 12 years in prison, a fine equivalent to 2,420.5 current legal monthly minimum wages, and disqualification from exercising public rights and functions as the main sanction for 100 months and 20 days. As the criminally responsible mastermind of the crime of bribery in criminal proceedings in homogeneous concurrence, in heterogeneous concurrence with procedural fraud in homogeneous concurrence, as stated in the motivational part of the sentence, committed under the circumstances of time, manner, and place detailed in the record. Third: To grant the convicted person the criminal substitute of house arrest regulated by Article 38B of Law 599 of 2000, under the obligation to comply with the provisions of Article 38B, numeral 4° of Law 599 of 2000, added by Article 23 of Law 1709 of 2014, subject to bail or judicial bond to guarantee compliance with his obligations, for the amount of 4 current legal monthly minimum wages. Fourth: To commission, since Mr. Uribe Velez resides in Rionegro, Antioquia, it is arranged to commission the Judicial Services Center of said locality to receive the bail imposed here, which must be deposited in favor of the Judicial Services Center of the Accusatory Criminal System in bank account 11.012.0480.01, if provided through bail or the corresponding judicial bond. Likewise, so that before said center he signs the commitment proceeding and the corresponding imprisonment warrant is issued, with the prison establishment in charge of surveillance having to proceed to his immediate transfer to his home, where he will serve house arrest and the respective controls will be carried out. Fifth: To ensure compliance by the Judicial Services Center of the Accusatory Criminal System with the provisions in the chapter on other determinations. This decision is notified in court. Against it, the ordinary appeal remedy proceeds before the Criminal Chamber of the Superior Court of Bogotá, an appeal that must be filed at this procedural moment and can be sustained orally within the same or in writing within the following five days." 10. THREE POLICE OFFICERS IN CHARGE OF GUARDING FACILITIES OF PALOQUEMAO JUDICIAL COMPLEXBOGOTA, COLOMBIA - AUG. 1: Former right-wing Colombian President Alvaro Uribe Velez has been sentenced to 12 years of house arrest in a decision delivered Friday by Judge Sandra Heredia. Uribe is also disqualified from holding public office for eight years and must pay a fine. Uribe, 73, received the maximum sentence after being found guilty of witness tampering and procedural fraud. It marks a historic moment as the first time a former Colombian president has been convicted and sentenced for a crime. Throughout the process, the former president has consistently maintained his innocence. Uribe's defense team has announced it will appeal the decision. If the Superior Court of Bogota maintains Heredia´s ruling, the case could escalate its appeal to the Supreme Court of Justice, where it began. The trial originated 13 years ago from a political debate in Congress between Uribe and Sen. Ivan Cepeda of the governing party. Cepeda insinuated Uribe's alleged links to extreme right-wing paramilitary groups in Colombia. In response, Uribe denounced Cepeda before the Supreme Court of Justice, alleging that the senator irregularly sought testimonies from imprisoned former paramilitaries across the country to link him to the illegal armed groups. But in 2018, the Supreme Court of Justice found insufficient evidence to proceed against Cepeda and closed his case. In the same ruling, the Court ordered an investigation into Uribe for alleged witness tampering to discredit his political adversary. The former leader was effectively accused of manipulating testimony. In 2020, the Court ordered Uribe's home detention. Before that decision, the former president resigned from his Senate seat, which moved his case to the ordinary justice system. He was formally charged with bribery, procedural fraud and witness tampering in May 2024. Subsequently, the Colombian Prosecutors' Office attempted to close the case against Uribe, but that petition was denied. Uribe is the most popular right-wing leader in Colombia, and a decisive figure in next year´s presidential elections. The case has drawn significant attention from US political figures, who have expressed concerns that Colombia's judicial system is being weaponized against the former president and have even threatened to cut financial aid. US Secretary of State Marco Rubio decried Uribe's prosecution, claiming that it represented "the weaponization of Colombia's judicial branch."
