EU Court Rules Same-Sex Marriages Must Be Recognised Across the Bloc. The EU’s top court rules that same-sex marriages must be recognised throughout all member states, rebuking Poland for refusing to acknowledge a marriage performed in Germany. Judges say Poland violated the couple’s freedom of movement and their fundamental right to private and family life. The case concerns two Polish citizens who married in Berlin in 2018 but were denied transcription of their marriage certificate after returning home. The EU Court of Justice stresses that citizens must be able to maintain “a normal family life” when they move within the bloc and upon returning to their home country. Though member states are not required to legalise same-sex marriage domestically, they cannot discriminate against couples legally married elsewhere. Poland’s previous government portrayed LGBT rights as a foreign threat, though the current administration is drafting a civil-partnerships bill. Progress on the bill is stalled due to pushback from a conservative coalition partner and the threat of a veto from nationalist President Karol Nawrocki. Lawyers for the couple declined to comment, but the ruling is binding and expected to shape future cases involving cross-border family rights.
