The conservative 5th Circuit Court of Appeals previously struck down Hemani’s prosecution, saying the ban could only apply if a person was actively intoxicated while armed. The Trump administration has asked the justices to reinstate the case, arguing that drug users should be broadly prohibited from owning firearms. Solicitor General D. John Sauer wrote that the rule is a “modest modern analogue” to historic laws restricting gun use by habitual drunkards.
