Supreme Court To Review Gun Law Used To Convict Hunter Biden. The U.S. Supreme Court will review the constitutionality of a federal law banning firearm possession by people who use or are addicted to illegal drugs. The law was the basis for Hunter Biden’s conviction last year before he was pardoned by his father, former President Joe Biden. The case before the court involves Ali Hemani, a Texas man charged after FBI agents found a gun and small amounts of marijuana and cocaine in his home. The conservative 5th Circuit Court of Appeals previously struck down Hemani’s prosecution, saying the ban could only apply if a person was actively intoxicated while armed. The Trump administration has asked the justices to reinstate the case, arguing that drug users should be broadly prohibited from owning firearms. Solicitor General D. John Sauer wrote that the rule is a “modest modern analogue” to historic laws restricting gun use by habitual drunkards. The case will test the scope of the court’s 2022 Bruen ruling, which required judges to look for historical precedents when assessing gun restrictions. The justices will hear arguments early next year, with a decision expected by June, alongside a separate case involving Hawaii’s gun-carry restrictions.
