Dispute over damaged bracelet at gym leads to police intervention

Recently in Changsha, southern China, a man was lifting weights at the gym when a woman walking past accidentally collided her jade bracelet with the barbell, resulting in damage to the bracelet. The woman later demanded compensation of 5000 yuan from the man, who found it unacceptable. Unable to reach a settlement on compensation, the man eventually had to seek assistance from the police.

Subsequently, some netizens pointed out that the same woman had experienced a similar incident of her bracelet breaking at a steam room in the past. At that time, the steam room owner offered to buy a bunch of such bracelets for 1000 yuan, but the woman claimed it was a gift from a friend and didn't know its value. She also expressed her intention to claim 5000 yuan in compensation from the steam room owner.

The feedback from netizens has yet to be confirmed by the police, and the incident is still under further negotiation and handling.

Regarding this, lawyer Zhao Liangshan stated that indeed, the female customer wore a bracelet while exercising and failed to exercise due care, thus bearing partial responsibility. The male customer also failed to fulfill his duty of careful observation of his surroundings, resulting in the collision that broke the woman's bracelet, thus also bearing partial responsibility. In addition, as the operator and manager of a public place, the gym should fulfill reasonable and prudent safety obligations and inform the woman not to wear valuable jewelry while exercising and to properly store valuable items. Therefore, in this case, the gym, the male customer, and the female customer are all at fault, and the responsibility of each party should be determined based on the extent of their respective faults.
