New video of fatal parole officer shooting 'contradicts police account,' family say
The family of a man shot dead by a parole officer say new video contradicts official state police accounts he was to blame.
Marchello Woodard, 43, was gunned down by his parole officer in Erie, Pennsylvania, on July 2, while sitting in a car.
As part of the preliminary investigation, a state police statement, said two parole agents were out doing "compliance checks" when they recognized Woodard."
It claims they identified themselves, prompting Woodard to drive away "dragging a State Parole Agent in the process" and that this is when "the agent fired multiple rounds into the driver's compartment of the vehicle before falling free of the vehicle"."
But Ring camera footage appears to show the shots ring out while the car is stationary - with the vehicle moving off after three shots have been fired.
There is no body camera footage from the parole officers because Pennsylvania law says it is not required.
Woodard's brother Dominick Bradley, 32, a civil rights activist from Erie, calls his brother's death "evil" and "calculated"."
The coroner ruled the death a homicide, but no arrests have been made.
"They gave my brother three gunshot wounds to the chest," Bradley. "He was unarmed. They had absolutely no reason to shoot him. "
"The excuse was to try to say that my brother was dragging the parole officer when they approached him, and that's the reason why the gunshots rang out."
"But when we look at the Ring videos, the car had never moved. "
"The shots rang out, and the car was still sitting, and the parole officer jumped out of his vehicle with his gun drawn."
"He had two weeks left before he was to get off parole."
"When I saw the video, it brought tears to my eyes."
"The first thing that ran through my head was 'what was the reason for this?'"
"Why would a person do this to somebody who was doing absolutely nothing, just minding their business in their vehicle?"
"What they did was evil, and it was very calculated in my eyes."
Woodard, who was on parole for drug possession, was nearly two weeks away from finishing.
According to his family, he was sat in his car with partner Chamell Henderson, 44, an Erie-based behavioral specialist, after returning home from dinner.
"On Wednesday, July 2, at approximately 9:44 p.m., the Erie Police Department responded to a reported shooting in the vicinity of East 27th and Parade Street," the department said in a statement."
"PA State Parole Agents reported they had shot an individual during an investigation they were conducting. The subject then drove away in a white car heading west on East 27th Street. "
They continued: "An Erie police unit responded to the call for help and observed the car coming towards them at East 27th and German with the driver slumped over inside the car and the vehicle still in motion. "
"Officers positioned their car in the path of the oncoming vehicle to prevent it from continuing into the intersection."
"Officers tactically approached the vehicle and discovered that the driver was incapacitated. They pulled him from the vehicle and started rendering aid immediately. "
"Additional officers arrived and assisted in rendering aid until EmergyCare arrived and transported the victim to the hospital. Unfortunately, the driver of the white car succumbed to his injuries. "
"Erie Police spoke to the State Parole Agent involved and had him also transported to the hospital for treatment of his injuries. "
"Erie Police contacted the Erie County District Attorney, and according to protocol, turned this investigation over to the PA State Police (PSP)."
The District Attorney and PSP will release details as they become available."
They added: "We reiterate that the Erie Police Department was not involved in the initial incident and will assist the State Police in their investigation."
Woodard's mother, Martha Bradley, 62, a retired aide also from Erie, said her son was "brutally murdered for no reason at all"."
"I still can't accept he's gone," she added."
"I still think he's going to come knocking on the door."
"It's hard. I've never been this hurt in my life."
The Erie County Coroner ruled Woodard's death a homicide after an autopsy revealed he was shot three times in the chest, according to police.
Mrs Bradley added: "I don't know why he hasn't been charged yet. It's been three months. I don't know any more than I did the first day."
His brother, Dominick Bradley, who runs a non-profit to help impoverished youth in the community, and another initiative to advocate for justice, said he believes his brother's shooting was premeditated and that officials never intended for Woodard to complete his parole successfully.
"I honestly think that they did this for no reason," Bradley said. "They planned to do this. They never planned for him to get off parole. "
"My brother was important to a lot of people, and we just can't allow him to die in vain."
Woodard leaves behind three children: a 22-year-old son, a 17-year-old daughter, and an eight-year-old son.
His death sparked community protests and candlelight vigils in Erie.
Bradley says the family - who has retained civil rights attorney Benjamin Crump - haven't had any updates on the case.
"We haven't heard anything from the District Attorney's office or anybody else, to be honest with you," Bradley said. "
"We need justice for our brother. His kids want justice. Our family wants justice, and we need to bring attention and awareness to this situation because they're trying to sweep it under the rug, and we can't let that happen."
In a statement, the Pennsylvania State Police said: "[We] conducted a thorough and impartial investigation, which was submitted to the Erie County District Attorney. "
"The Pennsylvania State Police does not provide recommendations or express opinions regarding potential charges or legal outcomes."
They added: "That responsibility rests entirely with the District Attorney, who will also determine if and when any additional information will be made public."
"If made public, it will come from the DA at the appropriate time."
The Erie County District Attorney's Office did not respond to request for comment.
